Deceased Estate Administration

Comprehensive management of estate liquidation and distribution, adhering strictly to The Administration of Estates Act 66 of 1965.

Our Mandate

Executors cede their administrative responsibilities to us through a Power of Attorney. As your appointed administrators, we undertake comprehensive asset inventory, liaison with relevant authorities for legal clearances, debts settlement, financial management, and timely reporting to beneficiaries.

The Administration Process

1

Consultation & Reporting

We engage in detailed discussions, complete all necessary reporting documents, and submit them to the Master of the High Court. We attend to any queries raised during the application process and collect the Letter of Executorship/Authority.

2

Verification & Asset Collection

We conduct thorough Deed and Company Directorship searches. We open the Estate Late Account and retrieve assets from financial institutions, including banks and insurance companies.

3

Creditors & Claims (Section 29)

We publish creditors' claims in both the Government Gazette and a local newspaper. We receive, assess, and verify any claims against the estate.

4

Drafting & SARS Returns

We prepare the detailed Liquidation and Distribution (L&D) account for estate settlements, and compile and draft the Estate Duty Return for submission to SARS. We lodge both with the relevant authorities and handle any queries.

5

Objections & Payments (Section 35)

We address objections (if any) raised through Section 35 advertisements. We ensure the prompt settlement of valid claims against the estate and facilitate the timely disbursement of assets to beneficiaries.

6

Transfer, Discharge & Retention

We manage property transfers (if applicable), seek the necessary approvals and discharge as executor from the Master, and securely safeguard files and relevant copies for a period of five years.

Timeframes & Fees

The process is lengthy and complex, typically taking 6 months to a year. We endeavor to complete the process in six months, but it depends on the unique complexities of each estate.

Any fee agreement and/or invoice transmitted will first be settled from the funds collected in the estate, and the balance from the client. We are always open to discussing payment arrangements to suit your situation.
